Preamble.
The company SUPRA SYSTEMS is a distribution company of products intended for professionals of the world of SPA, institutes of beauties and any other professional with a relationship to beauty and well being. SUPRA SYSTEMS is registered in the Trade and Companies Register of Pontoise..
Article 1. Purpose.
The purpose of these General Conditions of Sale is to define, exclusively on the basis of the relationships which they establish on the Internet and outside the electronic network, postal, paper catalogue, the rights and obligations of the Parties arising from the sale of the Products offered by jack success.. These are therefore applicable to any sale proposed by supra systems
Article 2. Products - Price
2.1. Products
The Products offered for sale by supra systems are those that appear on the Website and the catalogue, on the day the buyer consults the support and within the limits of available stocks. In case of unavailability of any of the Products, the Buyer will be informed at the latest during the delivery of the order. It is already specified that suprasystems may substitute the unavailable Product(s) by a similar Product(s) of at least equivalent value. If the Buyer does not wish to retain the Substituted Product, he will have the opportunity to obtain a refund of the Replaced Product. To do so, the Buyer must return the Substituted Product, unused, unopened in its original packaging, to the company’s billing address. The company jack success can apply a discount of the product in case of non-compliance of the packaging to restore the product for resale. The Buyer will make sure to attach to his parcel a written request specifying the reasons for the return and the number of his order as well as the double of his invoice.
2.2. Price
Prices are quoted in Euros and are valid in Metropolitan France, Corsica and Monaco. They take into account any discounts applicable on the day of the order, unless there are significant changes to the charges and in particular to VAT. These prices are exclusive of tax from our headquarters. A tariff proposal may be made for other destinations. The supra systems company reserves the right to change prices at any time, as long as the pricing policy of its suppliers is modified.
The prices indicated on the website or the catalogue are guaranteed until the expiry date indicated in the offer. The prices displayed in the catalogues are valid until the date indicated in these catalogues and within the limit of available stocks. Until a new catalogue is published. Any new edition cancels and replaces the previous one. The prices indicated do not take into account the shipping and packaging costs that may be charged in addition and amount to 20 € per order for consumable products and small equipment. Pricing for equipment and furniture is implemented and offered to clients. It is specified that any promotions granted in the form of vouchers are valid only for one order per customer and over a given period of validity.
Article 3. Delivery
supra systems will do its best to ensure that all orders are shipped as quickly as possible. Any premium or express service decided by the customer is the responsibility of the customer himself.
Prices are set from our headquarters in Department 95.
The packing and shipping costs remain in addition for any order less than 160 €VAT. Orders for furniture or facilities will be subject to custom pricing. Any heavy or very large delivery may also be subject to a special quotation. Quotation based on elements related to the weight, volume, value, and destination of the delivery. Any order less than €250 before tax will be increased by an amount of €20 before tax. For Corsica and the DOM-TOM will be calculated shipping costs at the time of the order always in connection with the elements related to weight, volume, value.
The amount of €20 excluding tax may be modified during the year.
The Products ordered by the Buyer will be delivered only in Metropolitan France, Corsica and Monaco, to the address indicated by the latter. The buyer will have the possibility to have the Products delivered to a different address than his own. supra systems will make its best efforts to ensure the delivery time of the order to the address designated by the Buyer. In the case of an out-of-territory shipment, a rate study will be carried out and proposed for delivery. In any case, the Products will be routed by the usual postal services or by carriers, jack success therefore declines all responsibility in case of too long delivery time due to postal services or means of transport, as well as in case of loss of ordered products or strike. The risks of transport are borne by the Buyer, who must lodge a reasoned protest with the postal services or the carrier, within a period of 48 working days from the delivery and this by registered letter.
In addition, it is specified that the ownership of the ordered products will be transferred to the Buyer only at the total payment of the invoiced price, including the shipping costs. Supra systems therefore retains ownership of the products sold until full payment and in the event of a postponement of maturity, in accordance with the terms of Law No. 80 335 of 12 May 1980. This being valid as soon as the products are deposited in his hands therefore as soon as they are delivered. This being said, despite all the care taken by jack success in the preparation of packages, a Product may be missing. Similarly, after transport of the package, one of the Products may prove to be defective. Therefore, upon receipt of his order, the Buyer will take care to verify the conformity of the Products received and will not fail to mention detailed reservations according to the codes governing the transport industry. Any anomaly concerning the delivery (Product missing or broken, damaged parcel, ) must be notified on the same day of receipt within 48H after receipt to the customer service of supra systems, by email to Customer Service at suprasculpt@gmail.com. Any claim made after this deadline will be rejected and supra systems will be released from all liability. supra systems reserves the right to ask the Buyer to return the defective Product. If the aforementioned conditions are met, jack success will then either exchange or refund the defective Product(s), or redirect the missing Product (subject to the merits of the Buyer’s request).
3.1. Massage chair and massage table, courier delivery
Delivery of massage chairs and massage tables can be done by courier. This delivery is made at the foot of the truck, meaning that the cardboard is delivered to the customer on the doorstep. Exceptionally, the delivery person can help move the equipment. This is not automatic. If a special service is required (moving or installing the equipment under special conditions), the service will be charged according to the provider’s rates. It is the same for deliveries off the ground floor (upstairs) or considered difficult (dimensions of the corridor or stairwell too narrow).
Article 4. Claims and after-sales service
For any complaint, we invite you to contact our services either by phone, mail or by logging on to our site and by going to the CONTACTS page. All claims relating to a defect in the delivered goods, an inaccuracy in the quantities or their incorrect reference to the accepted offer or the confirmation of the order by the seller, shall be sent to the seller by registered mail within 48 hours of receipt of the goods, without neglecting, where necessary and in accordance with Article 4, the remedies against the carrier, failing which the buyer’s right to claim shall cease to be acquired.
4.1 Need for a Return Number
Goods are returned only by post, unless otherwise specified. Any return of goods requires the prior approval of supra systems and a return number, which can be obtained free of charge through our employees. You will receive a return agreement by the means deemed most appropriate by supra systems. In the absence of a return agreement, the goods will be returned to you or kept at your disposal, at your expense, risks and perils, any transport, storage, handling costs being at your expense. After obtaining the return agreement, the buyer has 7 days to return the defective goods to the seller. The following information is generally requested: precise contact information, identification of the item or items concerned, serial number, the fault or malfunction found and the invoice or delivery note number corresponding to the parts described. The goods must be returned with a copy of the invoice and the return number appearing on the package within a maximum of 7 days after agreement return supra systems
4.2 Need for Original Packaging
Any defective product must be returned in its original packaging, which alone ensures the transport of the product in good conditions. The product must be accompanied by all its accessories and be accompanied legibly by the return number. Any product incomplete, damaged, damaged and/or whose original packaging has been damaged, will not be taken back or exchanged, nor refunded and you will have to pay the sum of €20 excl. tax in order to cover the costs of repackaging the parts whose original packaging has disappeared or been damaged. The shipper must therefore ensure the packaging and packaging of the material he is sending. In particular, the consignee may redirect the goods to a destination other than the original destination with the same packaging, at the risk of the consignor being held responsible for any damage that occurred during that subsequent transport.
4.3 Repayment
Any refund request can only be taken into account after the arrival of the products returned to supra systems according to the return procedure indicated above. In the event of a return and a refund request, the terms and conditions will be as follows:
- Returned parcel of the customer’s will: refund of the product, costs of return at the customer’s expense.
- Parcel returned due to the responsibility of the company (non-compliance, package not arrived...): refund of the product, shipping costs and return costs.
4.4 Payment of shipping costs
As part of the guarantee, the shipping costs for the return of material are the responsibility of the buyer.
4.5 Order error
If the return of the goods is due to an order error emanating from the buyer a reduction of 20% will be applied on the value of the returned product(s). Any credit note issued will be deducted from a subsequent invoice and will in no case give right to an immediate refund.
Article 5. Payment
Any settlement paid to supra systems cannot be considered as a deposit.
5.1 Methods of Payment
Payments must be made in such a way that the seller can dispose of the amounts on the due date shown on the invoice. Payment shall be made in the following manner:
-credit card: All login information is not stored under any circumstances.
-Paypal account.
5.2 Supporting documents
For reasons of fraud limitations, supra systems reserves the right to accept the sale to ask you to justify your identity and place of residence, and the means of payment used. In this case, your order will be processed as of receipt of these documents. We reserve the right to cancel your order if we do not receive these documents or receive documents deemed non-compliant.
Article 6. Miscellaneous stipulations
6.1. Force majeure
supra systems shall not be liable for the total or partial non-performance of its obligations under this Agreement, if such non-performance is caused by a force majeure event, in particular in the event of a total or partial disturbance or strike, including postal services and means of transport and/or communication, flooding, fire. Events that meet the criteria set by the jurisprudence of the 2nd Civil Chamber of the Court of Cassation will be considered as force majeure. In the event of a force majeure event, jack success will notify the User/Buyer within five (5) business days of the occurrence or threat of that event. The Parties agree that they must consult as soon as possible in order to determine together the terms of execution of the order during the case of force majeure. Beyond a period of one (1) month of interruption due to force majeure, supra systems may not honour the order, at the cost of reimbursing the Buyer if applicable.
6.2. Partial non-validity
If one or more stipulations of these General Conditions of Sale are deemed invalid or declared as such by law, by regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.
6.3. Entire Contract
These general conditions of sale and the order summary sent to the Buyer constitute a contractual package and constitute the entire contractual relationship between the Parties. In case of contradiction between these documents, the general conditions of sale will prevail.
6.4. Applicable Law
These general conditions of sale and the contractual relations between supra systems and the Buyer are subject to French law. In case of dispute, an amicable solution will be sought before any legal action. In the event of a dispute, the Tribunal de Commerce of Pontoise shall have exclusive jurisdiction, regardless of the methods of dispatch or payment, the acceptance of payment against refund, regardless of the place of delivery, the jurisdiction conferring jurisdiction is formal and in no case can there be novation or derogation from the present.
6.5. After-sales service
The products distributed by supra systems are manufactured with the necessary care to the satisfaction of the customer.
If the material is guaranteed, the delivery note acts as warranty documentation. The warranty covers all manufacturing or assembly material defects. In the event of a failure or malfunction of the equipment distributed by supra systems, the customer must return the entire equipment to the address indicated by our services, together with a copy of the delivery note. The equipment supplier shall repair or replace the equipment and return it to the customer’s home within 90 days of receipt of the equipment under warranty. The shipment of parts or repairs to the equipment shall be carried out by the supplier himself, unless the Seller deems that he may substitute himself for the supplier. The costs of return transport are borne by the Buyer. If the return is deemed too voluminous by the Seller, the Seller gives itself the right to send directly to the Buyer the part or parts to be changed so that the latter can carry out the repair itself. This is especially the case for massage chairs and massage tables, which guarantee exclusively on the parts. For the proper functioning of the guarantee, the customer undertakes to return the goods in their original packaging. The warranty is excluded in the following cases: abnormal wear or not in accordance with the instructions for use of the equipment or its accessories; accident resulting from a shock or the effect of water, or solvent or oil, heat or any substance; attempted repair by a third party not authorised by supra systems, deliberate degradation
